Supreme Court ने सवाल उठाया है कि PMLA Adjudicating Authority की single-member bench, judicial member के बिना, Enforcement Directorate के attachment orders की adequate review कर सकती है या नहीं.
Petitioners का argument है कि authority quasi-judicial function perform करती है क्योंकि उसे decide करना होता है कि provisional property attachment continue होना चाहिए या नहीं. Court ने workload और statutory timelines के भीतर large number of cases की quality of scrutiny पर भी सवाल उठाए.
Issue institutionally important है क्योंकि criminal trial complete होने से पहले भी attachment serious civil consequences पैदा कर सकता है. Court ने decision reserve किया है और ED से relevant data मांगा है.
