Bankers' Books Evidence Act, 2026 will take effect on October 1 and modernise how banking records are used in court

The Bankers' Books Evidence Act, 2026 will come into force on October 1, replacing the Bankers' Books Evidence Act, 1891.

The new law updates the legal treatment of banking records for an era in which account information, transaction logs and bank documents are increasingly digital. It also seeks to simplify and standardise certification so records can be used more efficiently in legal proceedings.

The reform matters because evidence law must establish authenticity without forcing courts and banks to reproduce outdated paper-era procedures. The deeper issue is how legal systems adapt evidentiary rules to digital records while preserving reliability and due process.
